Affiliate marketing liability is the regulatory principle that a licensed gambling operator is responsible for marketing carried out on its behalf by third parties, including affiliates. If a partner publishes an advertisement that breaches the rules, the enforcement action lands on the licence holder, not only on the partner. The principle is standard across regulated markets and appears in licence conditions rather than in advertising codes alone. Great Britain states it explicitly: the licensee is responsible for third parties conducting marketing on its behalf, and must take steps to ensure they comply. Other regulators reach the same place through advertising law, since the advertiser who benefits from a promotion is treated as its publisher. This explains behaviour that otherwise looks like overreach. Programmes vet creative, ban particular phrases, insist that bonus terms appear beside any bonus figure, prohibit any suggestion that gambling solves money problems, and forbid imagery or placement likely to appeal to under-eighteens. None of that is fussiness about brand tone; it is the operator managing an exposure that has its own name on it. It is also why an operator will terminate a productive affiliate over a compliance breach that costs the operator nothing directly — a regulatory finding is worth far more than the traffic. An affiliate page that states its commercial relationship, prints the wagering terms next to the offer and carries age and responsible-gambling messaging is not merely being polite; it is operating inside a chain of responsibility somebody can be sanctioned under.
